Scholar Shield Legal Documents (“we” or “us”) is pleased to provide our customer(s) (“you”) with access and use of our website and documents service (“Site”). This Terms of Use Agreement (“Agreement”) governs your use of our main Site, located at http://www.scholar-shield.com, and all Sites that link to it. Before accessing, registering, and otherwise using our Site, please read this Agreement carefully. This Agreement forms a legally binding contract between you and us. This Agreement cannot be modified without a writing.

BY USING THIS SITE, YOU AGREE TO THIS AGREEMENT AND AFFIRM THAT YOU ARE ABLE AND LEGALLY COMPETENT TO DO SO. If you do not agree to all terms of this Agreement, you must immediately leave and not return to this Site. Otherwise, by accessing and using this Site, even if you do not pay for any services, you are agreeing to be bound by this Agreement. By using our service, whether or not you provide payment for legal documents, you are accepting and agreeing to the Agreement, including Terms of Use and Privacy Policies, “as is” without any changes, as set forth below.

• IF YOU ARE A CALIFORNIA RESIDENT, YOU WAIVE YOUR RIGHTS WITH RESPECT TO CALIFORNIA CIVIL CODE SECTION 1542, WHICH SAYS “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH, IF KNOWN BY HIM MUST HAVE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE DEBTOR.”

Use of Services

• You must be over the age of 16 to use this service.
• Scholar Shield Legal Documents retains the copyright to all content on this website.
• You may not re-sell access to our service.
• You are not permitted to use the Site for any illegal purpose.
• Excessive use, abuse, or any use that interferes with the use of the system by others is not allowed.
• We have total discretion to terminate your account and/or your access to the Site without further notice if you violate any of your agreements or any of the prohibitions set forth in this Agreement.
• Unauthorized use or misuse of the Sites are strictly prohibited, and, depending on the circumstances, may subject you to a civil claim for damages and criminal prosecution. 
• We reserve the right to report any breach of this Agreement or unauthorized use or misuse of the Site to law enforcement authorities.
• You agree not to incorporate our content into any other work, whether private, public, or in any commercial manner, and not to change any copyright notice or other intellectual property rights that may be part of the content you receive without our prior written permission.  

Information We Collect

• Information that you type in the guided interview, which may include private information such as your name, address, and identification numbers.
• Information sent automatically by your web browser, which includes information about your information service provider, your location and third-party analytics such as Google Analytics. This information is used to protect the system from unauthorized use and to understand the demographics of the users of our site and to improve the forms and interviews contained on this site.
• Information from your web browser may be stored in computer logs for up to 180 days and reviewed to maintain the security of our system. Anonymous analytics may be stored indefinitely.
• We use cookies and offer the option of using a login to identify you, to allow you to return to the site and finish an interview that is in progress.

Information We Share

• We will never sell or share the data you enter in our guided interview, such as names, addresses, birthdates, or contact information.
• Third-party analytics that we use for free to improve our website may also be used to improve Google’s delivery of services to you.
• We may use a third party service to store saved answers from completed interviews. We will delete your information upon written request.
• The Site can be accessed from a browser on a desktop or mobile device, or from apps created by third-party application developers, and as such we are not responsible for cookies and data collection by such outside services.

How We Protect Your Information

• All information sent to our servers and sent back to you is encrypted with standard HTTPS SSL encryption to protect it from other users on your network or in between your computer and the Scholar Shield website. Your information is never sent over an unencrypted channel.
• We make use of software controls, firewalls, and continuous monitoring to protect your information and to maintain the security of the website.
• Access to your responses is limited to logged-in and authorized personnel of Scholar Shield Legal Documents.
• Please note, however: if you share a link to your interview, any person with that link may have access to the responses you gave in that interview.

Limitation of Liability

We make no claims, promises, or guarantees about the absolute accuracy, completeness, or adequacy of the contents of this website and the documents you receive, and expressly disclaim liability for errors and omissions in the contents of the Site or the documents provided by our service.

NO WARRANTY OF ANY KIND, IMPLIED, EXPRESSED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF NON-INFRINGEMENT OF THIRD PARTY RIGHTS, TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND FREEDOM FROM COMPUTER VIRUS, IS GIVEN WITH RESPECT TO THE CONTENTS OF THIS WEBSITE OR ITS HYPERLINKS TO OTHER INTERNET RESOURCES.

WE WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES) RESULTING FROM THE USE OR THE INABILITY TO USE THE SERVICE.

Indemnification.

You agree to defend, indemnify, and hold harmless Scholar Shield Legal Documents, our affiliates, and our respective, officers, employees, and agents from and against any and all claims, actions, suits, or proceedings, as well as any and all losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) any material provided by you that infringes any copyright, trademark, trade secret, patent, or other intellectual property right of any person or defames any person or violates their rights of publicity or privacy; (b) any misrepresentation made by you in connection with your use of the website; (c) any violation by you of this Agreement; and (d) any claims brought by other persons or entities arising from or related to your use of the website.

General Terms

• We may modify, alter, or update this Agreement at any time with or without notice. Please review the link on a regular basis for any such changes. Any amended Agreement will supersede all previous versions of such Agreement, but changes will not apply retroactively.
• If you continue to use our website following a change to these Terms of Use, you will be deemed to have accepted the changes.
• If any term or condition set out in this Terms of Use is held to be invalid, unenforceable or illegal for any reason, the remaining terms and conditions will continue in full force.
